The Valuation Office originally entered the subject building as a new assessment in the Rate List when they believed construction work had finished.
As a completion notice had not been served by the local council, on appeal we succeeded in deleting the rate list entry. We proved that for rating purposes the property could not be assumed to be capable of beneficial occupation. We reached agreement that the effective date of the assessment should be the day our client occupied the unit. Consequently, rather than pay full empty rates, our client benefitted from a zero liability for the 9 months between taking possession of the site and the date they opened for business.
In addition, based on evidence of market values for distribution warehouses in the region, we were able to negotiate a significantly reduced valuation with the Valuation Office to reduce the ongoing liability faced by our client.
