Restrictive Covenant Release, Bedfordshire

DWD was appointed to advise on the release of a restrictive covenant that impeded certain uses taking place on land owned by our client in Bedfordshire.

Planning permission for employment uses has been secured on the land, which comprised of over 6.5 acres. Our client had agreed terms to dispose of the site to an employment user. The terms agreed with the land purchaser required our client to release the restrictive covenant prior to completion.

DWD advised our client on the options available to them to release the restrictive covenant and on its enforceability. We prepared Instructions to Counsel and received Counsel s Opinion. The Opinion was used to support negotiations to release the covenant by agreement with the beneficiary of the covenant.

DWD worked within a tight timeframe to ensure that the covenant was released and our client was able to complete the land sale in December 2017, in accordance with the timeframe agreed with the land purchaser.
